Beyond Structured Settlements: Structured Settlements in 2012 - 4

Executive Life of New York

At one time or another, each of us may have become acquainted with individuals who have overcome personal injuries and successfully transformed their disabilities and special needs into special lifetime accomplishments. Kyle Walsh, profiled in a 2012 S2KM blog post, is one such individual. The late Randy Snow, featured in a 2008 S2KM blog series, was another.

Structured settlements are supposed to provide economic security for people with serious injuries and disabilities - to help them rebuild their lives and, in many cases, to achieve special lifetime accomplishments. Instead of an all-cash personal injury settlement, structured settlement recipients accept a promise of future periodic payments.

What happens, if and when, that promise is broken? What happens when a structured settlement funding company, and the regulators and guaranty system responsible for protecting the structured settlement recipients, fail to make and/or insure full payment?

These questions are highlighted by the Executive Life of New York (ELNY) liquidation - the dominant structured settlement story of 2012 and one of the most important developments in the history of the United States structured settlement industry.

The story of ELNY, as well as its affiliate Executive Life of California (ELIC), and their parent company, First Capital Corporation (FEC), is long and complex. For background of events prior to ELNY's 1991 receivership, S2KM recommends Gary Schulte's 1992 book "The Fall of First Executive".

Significantly, neither the 1991 ELNY Rehabilitation Order nor the 1992 Order approving the ELNY Rehabilitation Plan declared ELNY to be insolvent. When then New York's Insurance Commissioner Salvatore Curiale seized control of ELNY on April 16, 1991 and placed it in receivership, he stated: "The company is currently neither in an insolvent or impaired condition. . . . I have not petitioned the Court to make a finding of insolvency. ELNY is a company well able to meet its current obligations."

Exactly twenty-one years later, on April 16, 2012, following 11 days of hearings at the Nassau County New York Supreme Court, presiding Judge John M. Galasso approved an Order of Liquidation and a Restructuring Agreement for ELNY as proposed by the Superintendent of the New York State Department of Financial Services (Superintendent), as ELNY's Receiver, and the National Organization of Life and Health Guaranty Funds (NOLHGA).

The result of the ELNY Liquidation Order and Restructuring Plan, even following contributions from state guaranty funds and voluntary life insurance company contributions, is a $900 million shortfall allocated entirely (and arguably inequitably) to more than 1400 ELNY payees out of a total of approximately 9700 current ELNY payees. The remaining ELNY payees expect to receive 100 percent of their promised future payments. The average individual shortfall is estimated to exceed $600,000 present value. Although an ELNY Hardship Fund has been created, it has not yet been funded.

An appeal was filed May 30, 2012, on behalf of 18 ELNY structured settlement shortfall payees, challenging the ELNY liquidation order and restructuring agreement on the basis of due process. The appeal also alleges that immunities and injunctions granted under the liquidation order are improper. Oral arguments occurred on November 15, 2012 in Brooklyn before the Appellate Division of the Supreme Court of the State of New York, Second Department. No decision has been announced.

Another legal challenge to the ELNY liquidation order occurred June 14, 2012 when attorneys for several liability insurers filed a Motion asking Judge John Gallasso to "clarify and/or correct" his April 16, 2012 ELNY Memorandum Decision. The motion indirectly raises the issue of whether qualified assignments extinguish the liability of defendants and/or liability insurers for shortfall payments resulting from the ELNY liquidation? Judge Galasso denied the Motion without further explanation.?

In a subsequent development, somewhat related to the liability insurers' motion, the ELNY website announced an ELNY Facilitation Plan to assist owners of ELNY structured settlement annuities (SSAs) make supplemental payments to ELNY SSA payees and to coordinate those payments with the ELNY benefit payments scheduled to be made by the Guaranty Association Benefits Company (GABC) under the ELNY Restructuring Plan approved by Judge Galasso on April 16, 2012 as part of the ELNY liquidation order.

The same attorneys who filed the ELNY appeal, Edward Stone and representatives of the Christensen & Jensen law firm, filed a class action lawsuit November 8, 2012, on behalf of ELNY shortfall victims, against Benjamin M. Lawsky, Superintendent of Financial Services of the State of New York, and his predecessor ELNY Rehabilitators, as well as MetLife and Credit Suisse. The class action allegations provide a critical litany of mismanagment and non-disclosure during the 21 years ELNY's estate was being supervised by these defendants.

In response, attorneys representing Benjamin M. Lawsky, in his capacity as ELNY's Receiver, filed a Notice of a Motion with the Nassau County New York State Supreme Court requesting oral argument on January 4, 2013 at 9:30 a.m. or as soon thereafter as the parties may be heard:

  • to enjoin three ELNY structured settlement shortfall payees and their legal counsel from proceeding with a class action lawsuit in the United States District Court Southern District of New York;
  • to hold in contempt of court the shortfall payees' legal counsel; and
  • to require their payment of the related costs and attorney's fees incurred by the Superintendent.

Although the ELNY liquidation has so far received limited coverage in the mainstream media, specialty insurance experts and analysts have not been silent. Examples:

  • Peter Bickford - In his article titled "The Elephant in the Court Room" (summarized here by S2KM), Bickford argues New York?s receivership system has failed ELNY, its policyholders and beneficiaries, as well as the insurance industry and its customers due to a lack of basic accountability standards. Although the ELNY restructuring plan may solve the immediate ELNY problem (at the expense of the remaining ELNY shortfall victims), Bickford maintains it does not address the broader, underlying systemic defects inherent in the New York life insurance receivership system. Without an act of the New York legislature, according to Bickford, "there will be no life insurance guaranty fund coverage in New York" following ELNY. Bickford's article also provides succinct summaries of objections raised by ELNY shortfall victims and ELNY legal issues which he states "could linger in the courts for years"
  • LifeHealthPro - In an article titled "The Complete ELNY Saga: 21 Years of Mismanagement, Corruption, Broken Promises and Shattered Lives", (summarized here by S2KM), the authors assign primary blame for ELNY insolvency to the NYLB which they describe as "a rogue agency known for its codes of secrecy and characterized by many who spoke for this story as ineffective and mismanaged at best, and a snake pit of corruption at worst". In a companion article (reviewed here by S2KM), writer Warren Hersch asks: "is the structured settlement process in need of reform"?? In a follow-up oped article titled "Governor Cuomo I'm Calling You Out", (summarized here by S2KM), Bill Coffin, LifeHealthPro's Group Editor, charges New York Governor Andrew Cuomo with personal responsibility to clean up the "ELNY debacle".

The final results of the ELNY liquidation will depend upon the outcome of the continuing litigation highlighted in this article. It also remains to be seen what reforms, if any, will result from the failed ELNY receivership process.

In conclusion, it should also be noted that ELIC-related litigation continued in 2012 (Garamendi v. Altus Finance S.A.) when a federal jury in Los Angeles rejected a claim by California's Insurance Commissioner that, but for a conspiracy by French investor group Artemis S.A.:

  • ELIC's original conservator (then California insurance commissioner John Garamendi) would have accepted an alternative bid in 1991 by state insurance guaranty associations; and
  • The alternative bid would have retained profits from ELIC's junk bond portfolio for the benefit of policyholders including ELIC structured settlement recipients.

The Max Planck Institute for the Study of Religious and Ethnic Diversity (Department for Socio-Cultural Diversity) is seeking to appoint

Applicants should have a degree in anthropology, sociology, political science, or geography. Applicants for the postdoctoral positions should have an excellent PhD, publications and envisage a research career.

Electric car crashes could pose new risk for first responders, group ...

CNN) ? Fuel-saving gas-electric hybrid and all-electric cars and trucks powered by sizable battery packs and high voltage motors could present a new kind of danger at serious accident scenes, according to an industry group.

A report by the Society of Automotive Engineers (SAE) highlighted risks to first responders and tow operators from potential electric shock from damaged systems not disengaged during or immediately after a crash.

?As electric vehicles enter the marketplace in greater numbers, it?s an appropriate time to recognize best practices that facilitate a safe response when these vehicles are in an accident,? said Todd Mackintosh, chairman of the SAE technical committee that issued the report earlier this month.

The group recommended automakers install switches that would kill battery power in the event of an accident. The location of those switches should be standardized for safety.

Another recommendation would create a guide for emergency workers, something Mackintosh called a ?cheat sheet for first responders.? It would quickly identify the location of high-voltage components allowing them to be disabled.

Tow truck drivers also need better information and training on how to handle hybrids and electric vehicles without receiving an unexpected jolt, the report said.

More than 435,000 battery powered electric and hybrid electric vehicles were sold in the United States this year, an increase of 53%, compared to 2011 sales numbers, according to the Electric Drive Transportation Association.

In May, auto industry officials and the National Highway Traffic Safety Administration (NHTSA) and the Energy Department discussed potential dangers faced by first responders from electrical charges produced by hybrid and electric cars.

NHTSA later issued interim guidance for consumers, emergency responders and tow truck operators to increase awareness about specific dangers.

Dangers can be reduced if responders have easy access to battery packs and if auto manufacturers create common disconnect locations in all hybrid and electric vehicles, NHTSA said.

Automakers are getting the message out to drivers and responders.

Nissan places the battery pack of its LEAF all-electric car in a steel case. The Japanese automaker also designed the battery pack to sense a crash and disable its electrical charge when involved in an accident.

Ford has published a guide for first responders encountering its Focus EV involved in accidents. The Focus EV includes what Ford calls ?Electric Badges,? which are clearly marked logos on the doors and trunk lid to warn responders of possible electric shock. Cables wrapped in orange high-voltage warning sleeves are located under the hood of the Focus EV.

General Motors, maker of the Chevy Volt, is also helping to prepare fire service and other first responders.

Moreover, GM took steps to better protect the Volt battery pack following a fire that flared after a crash test in 2011. NHTSA found no defect with the lithium-ion battery system nor were any real world crash-fires ever reported. But the case highlighted potential safety concerns for first responders.

Dec 28 (Reuters) - Barcelona president Sandro Rosell says coach Tito Vilanova, who suffered a recurrence of cancer in his saliva glands earlier this month, will be back at work midway through January.

Vilanova underwent surgery on Dec. 20, a day after the club announced that the 44-year-old's condition had returned. He first had treatment in 2011.

"He'll be back within 15 or 20 days, but he must spend some days at the hospital and rest," Rosell told reporters in Dubai on Friday.

"He will mix work with his treatment. The most important thing is his health. Right now football comes second," added Rosell.

Barcelona have made a record-breaking start to their first season under Vilanova, who replaced friend Pep Guardiola at the helm at the end of the last term, by dropping only two points in 17 matches to lead La Liga by nine points.

Former President George H.W. Bush in intensive care

HOUSTON (AP) ? Former President George H.W. Bush has been admitted to the intensive care unit at a Houston hospital "following a series of setbacks including a persistent fever," but he is alert and talking to medical staff, his spokesman said Wednesday.

Jim McGrath, Bush's spokesman in Houston, said in a brief email that Bush was admitted to the ICU at Methodist Hospital on Sunday. He said doctors are cautiously optimistic about his treatment and that the former president "remains in guarded condition."

No other details were released about his medical condition, but McGrath said Bush is surrounded by family.

The 88-year-old has been hospitalized since Nov. 23, when he was admitted for a lingering cough related to bronchitis after having been in and out of the hospital for complications related to the illness.

Earlier Wednesday, McGrath said a fever that kept Bush in the hospital over Christmas had gotten worse and that doctors had put him on a liquids-only diet.

"It's an elevated fever, so it's actually gone up in the last day or two," McGrath told The Associated Press. "It's a stubborn fever that won't go away."

But he said the cough that initially brought Bush to the hospital has improved.

Bush was visited on Christmas by his wife, Barbara, his son, Neil, and Neil's wife, Maria, and a grandson, McGrath said. Bush's daughter, Dorothy, was expected to arrive Wednesday in Houston from Bethesda, Md. The 41st president has also been visited twice by his sons, George W. Bush, the 43rd president, and Jeb Bush, the former governor of Florida.

Bush and his wife live in Houston during the winter and spend their summers at a home in Kennebunkport, Maine.

The former president was a naval aviator in World War II ? at one point the youngest in the Navy ? and was shot down over the Pacific. He achieved notoriety in retirement for skydiving on at least three of his birthdays since leaving the White House in 1992.

Israel: No proof chemical weapons used in Syria

JERUSALEM - Israel voiced doubt on Tuesday about claims that chemical weapons had been used against rebels fighting to topple President Bashar Assad.

Activists on Monday claimed civilians had suffered injuries consistent with exposure to some kind of poisonous gas.

"We have seen reports from the opposition. It is not the first time. The opposition has an interest in drawing in international military intervention," Vice Prime Minister Moshe Yaalon said on Army Radio.

"As things stand now, we do not have any confirmation or proof that (chemical weapons) have already been used, but we are definitely following events with concern," he said.

Syria activists: Several die after Assad's forces use 'poisonous gases'

The Syrian Observatory for Human Rights gathered activist accounts on Sunday of what they said was a poison gas attack in the city of Homs. The reports are difficult to verify, as the government restricts media access in Syria.

The Observatory, a British-based group with a network of activists across Syria, said those accounts spoke of six rebel fighters who died after inhaling smoke on the front line of Homs's urban battleground. It said it could not confirm that poison gas had been used and called for an investigation.

Syria has said it would never use chemical weapons against its citizens.

Asked about images purported to show patients being treated for possible gas poisoning, Yaalon said: "I'm not sure that what we're seeing in the photos is the result of the use of chemical weapons.

"It could be other things," he said, without elaborating.

On Sunday, senior Israeli defense official Amos Gilad said Syria's chemical weapons were still secure despite the fact that Assad had lost control of parts of the country.

As Syria's southern neighbor, Israel has been concerned about chemical weapons falling into the hands of Islamist militants or Lebanese Hezbollah fighters, cautioning it could intervene to stop such developments.?

Earlier this month, President Barack Obama warned Assad that the?use of chemical weapons by his regime would be "totally unacceptable.""If you make the tragic mistake of using these weapons there will be consequences and you will be held accountable," he said.

Firemen's killer left chilling note, deaths at 3

WEBSTER, N.Y. (AP) ? An ex-con killed two firefighters with the same caliber and make military-style rifle used in the Connecticut school massacre after typing a note pledging to burn down his neighborhood and "do what I like doing best, killing people," police said Tuesday as another body, believed to be the gunman's missing sister, was found.

William Spengler, 62, who served 17 years in prison for manslaughter in the 1980 hammer slaying of his grandmother, set his house afire before dawn Christmas Eve before taking a revolver, a shotgun and a semiautomatic rifle to a sniper position outside, Police Chief Gerald Pickering said.

The death toll rose to three as police revealed that a body believed to be the killer's 67-year-old sister, Cheryl Spengler, was found in his fire-ravaged home.

Authorities say he sprayed bullets at the first responders, killing two firefighters and injuring two others who remained hospitalized Tuesday in stable condition, awake and alert and expected to survive. He then killed himself as seven houses burned on a sliver of land along Lake Ontario.

Police recovered a military-style .223-caliber semiautomatic Bushmaster rifle with flash suppression, the same make and caliber weapon used in the elementary school massacre in Newtown, Conn., that killed 26, including 20 young children, Pickering said.

The chief said it was believed the firefighters were hit with shots from the rifle given the distance but the investigation was incomplete.

"He was equipped to go to war, kill innocent people," the chief said.

The two- to three-page typewritten rambling note left by Spengler did not reveal what set off the killer or provide a motive for the shootings, Pickering said. He called the attack a "clear ambush on first responders."

He declined to reveal the note's full content or say where it was found. He read only one chilling line: "I still have to get ready to see how much of the neighborhood I can burn down, and do what I like doing best, killing people."

Pickering said it was unclear whether the person believed to be Spengler's sister died before or during the fire.

"It was a raging inferno in there," Pickering said.

A next-door neighbor said Spengler hated his sister and they lived on opposite sides of the house.

Roger Vercruysse said Spengler loved his mother, Arline, who died in October after living with her son and daughter in the house in a neighborhood of seasonal and year-round homes across the road from a lakeshore popular with recreational boaters.

As Pickering described it and as emergency radio communications on the scene showed, the heavily armed Spengler took a position behind a small hill by the house as four firefighters arrived after 5:30 a.m. to extinguish the fire: two on a fire truck; two in their own vehicles.

They were immediately greeted by bullets from Spengler, who wore dark clothing. Volunteer firefighter and police Lt. Michael Chiapperini, 43, driving the truck, was killed by gunfire as the windshield before him was shattered. Also killed was Tomasz Kaczowka, 19, who worked as a 911 dispatcher.

Several firefighters went beneath the truck to shield themselves as an off-duty police officer who was passing by pulled his vehicle alongside the truck to try to shield them, authorities said.

The first police officer who arrived chased and exchanged shots with Spengler, recounting it later over his police radio.

"I could see the muzzle blasts comin' at me. ... I fired four shots at him. I thought he went down," the officer said.

At another point, he said: "I don't know if I hit him or not. He's by a tree. ... He was movin' eastbound on the berm when I was firing shots." Pickering portrayed him as a hero who saved many lives.

The audio posted on the website RadioReference.com also has someone reporting "firefighters are down" and saying "got to be rifle or shotgun ? high-powered ... semi or fully auto."

Spengler had been charged with murder in his grandmother's death but pleaded guilty to a reduced charge of manslaughter, apparently to spare his family a trial. After he was freed from prison, Spengler ? a felon who wasn't allowed to possess weapons ? had lived a quiet life on Lake Road on a narrow peninsula where Irondequoit Bay meets Lake Ontario.

That ended when he left his burning home Monday morning, armed with his three weapons and a lot of ammunition.

"I'm not sure we'll ever know what was going through his mind," Pickering said.

After hinting in a Japanese press release that it'll out a bevy of new Google TV offerings in 2013, LG has firmed up the details, saying it'll launch seven new models at CES next January. Those include 42-, 57-, 50-, 55- and 60-inch models from the upcoming GA6400 series, along with 47- and 55-inch Cinema Screen panels included in the new GA7900 series. All the screens will ship with a redesigned Magic Qwerty Remote, which uses a full keyboard along with "natural language recognition" via a built-in microphone. Together with built-in Google search functions, that'll allow users to find "broadcast TV or internet content with only one vocal command," according to LG. Other features include the OnLive gaming platform app, a home dashboard to display other apps and content, LG's PrimeTime Quick Guide for browsing TV shows or movies, and a full browser. Acute lymphatic leukemia (ALL) is the most common cancer in children under the age of 14 years. With optimum treatment, approximately 75 % of children are currently cured, but the treatment consists of severe chemotherapy with many side effects. In collaboration with international research teams, scientists at VIB, KU Leuven and UZ Leuven have identified new genetic mutations that lead to T-ALL, a variant of ALL. They have unmasked the ribosome the molecular machine in the cell that is involved in the production of proteins as a weak spot in leukemia cells. Their research has also shown that there is a difference in T-ALL between adults and children. Both findings can be important in the search for improved treatments for T-ALL.

T-cell acute lymphatic leukemia (T-ALL)

The formation of white blood cells is disrupted by leukemia. The cells in the bone marrow that should mature into white blood cells multiply unchecked without maturing completely. These immature blood cells compromise the production of normal blood cells. This makes patients more susceptible to infections. Leukemia occurs in different forms; in the case of T-ALL, there is an accumulation of immature white blood cells over a very short period of time. With optimum treatment involving chemotherapy approximately 75 % of children are currently cured. For adults, the chance of a cure is below 50 %. Chemotherapy is associated with many side effects. The search for a more specific treatment can only start once we know what causes T-ALL.

7 new genes with a key role in T-ALL identified

T-ALL only occurs if errors in various genes occur simultaneously. It is important to determine which genes play a key role. Kim De Keersmaecker, Zeynep Kalender Atak, Jan Cools and Stein Aerts have identified a series of defects in 15 important genes, of which 7 have not previously been associated with T-ALL. They used next-generation sequencing to analyze the 20,000+ genes of 67 T-ALL patients. This technique allows for very fast analysis and comparison of the complete DNA sequence of healthy and sick individuals.

A difference between adults and children

The investigators from Leuven also discovered a difference between T-ALL in children and in adults. T-ALL in adults contains significantly more mutations than in children. The leukemia cells in adults also contain mutations in other genes than in children. This genetic difference could be a possible explanation why adults do not respond as well to the current therapy.

RPL5 and RPL10 two newly identified genes form part of the ribosome: this is the complex in the cell that produces proteins. The scientists hereby demonstrated for the first time that defects in the ribosome can also play a role in cancer activation. Experiments in yeast cells confirm that mutations in RPL10 cause a change in the ribosome.

Kim De Keersmaecker (VIB/KU Leuven):"This could be a weak point of the leukemia cells: all cells need properly functioning ribosomes to survive and to grow. These 'defective' ribosomes in the leukemia cells could be a new suitable target for the development of targeted therapies."
